Common use of Purchase of New Notes Clause in Contracts

Purchase of New Notes. Upon and subject to the terms of this Agreement and in reliance of the representations and warranties set forth herein, the Company hereby agrees to issue to the Holders, and the Holders agree, severally and not jointly, to acquire from the Company, at the Closing, New Notes in the aggregate principal amount of $18,472,000 in exchange for the cancellation of the Holders’ beneficial interests in the Prior Notes as described in Section 1.1 above.

Purchase of New Notes. Upon and subject to the terms of this Agreement and in reliance of the representations and warranties set forth herein, the Company hereby agrees to issue to the Holders, and the Holders agreeeach Holder, severally and not jointly, agree to acquire from the Company, at the Closing, New Notes in the aggregate principal amount of $18,472,000 1,368,000 in exchange for the cancellation of the Holders’ beneficial interests in the Prior Notes as described in Section 1.1 above.

Purchase of New Notes. Upon and subject to the terms of this Agreement and in reliance of the representations and warranties set forth herein, the Company hereby agrees to issue to the Holders, and the Holders agreeeach Holder, severally and not jointly, agree to acquire from the Company, at the Closing, New Notes in the aggregate principal amount of $18,472,000 6,925,000 in exchange for the cancellation of the Holders’ beneficial interests in the Prior Notes as described in Section 1.1 above.

Purchase of New Notes. Upon and subject to the terms of this Agreement and in reliance of the representations and warranties set forth herein, the Company hereby agrees to issue to the HoldersHolder, and the Holders agree, severally and not jointly, Holder agrees to acquire from the Company, at the Closing, New Notes in the aggregate principal amount of $18,472,000 13,978,000 in exchange for the cancellation of the Holders’ Holder’s beneficial interests in the Prior Notes as described in Section 1.1 above.

Purchase of New Notes. Upon and subject to the terms of this Agreement and in reliance of the representations and warranties set forth herein, the Company hereby agrees to issue to the Holders, and the Holders agree, severally and not jointly, to acquire from the Company, at the Closing, New Notes in the aggregate principal amount of $18,472,000 15,119,000 in exchange for the cancellation of the Holders’ beneficial interests in the Prior Notes as described in Section 1.1 above.

Purchase of New Notes. Upon and subject to the terms of this Agreement and in reliance of the representations and warranties set forth herein, the Company hereby agrees to issue to the Holders, and the Holders agreeeach Holder, severally and not jointly, agree to acquire from the Company, at the Closing, New Notes in the aggregate principal amount of $18,472,000 3,417,000 in exchange for the cancellation of the Holders’ beneficial interests in the Prior Notes as described in Section 1.1 above.

Purchase of New Notes. Upon and subject to the terms of this Agreement and in reliance of the representations and warranties set forth herein, the Company hereby agrees to issue to the HoldersHolder, and the Holders agree, severally and not jointly, Holder agrees to acquire from the Company, at the Closing, New Notes in the aggregate principal amount of $18,472,000 13,987,000 in exchange for the cancellation of the Holders’ Holder’s beneficial interests in the Prior Notes as described in Section 1.1 above.
