Purpose of privileges and immunities. (1) The privileges and immunities provided for in this Agreement are not designed to give to officials or official visitors of the Secretariat personal advantage. They are granted solely to ensure that the Energy Community is able to perform its official activities unimpeded at all times and that the persons to whom they are accorded have complete independence. (2) The Energy Community shall waive immunity where it considers that such immunity would impede the normal course of justice and that it can be waived without prejudicing the interests of the Energy Community.
