Qualified Mortgagees’ Cure Rights. Prior to terminating this Lease or exercising any other right or remedy hereunder for a Default by Xxxxxx, Lessor will give each Qualified Mortgagee notice of such Default by Lessee and afford it a period of 30 days after such notice is given in which to cure such Default by Lessee; provided, however, that (i) if such Default by Lessee is not a failure to pay Rent and is susceptible of cure by a Qualified Mortgagee but cannot reasonably be cured within such 30-day period, then so long as any Qualified Mortgagee commences a cure within such 30-day period (and notifies Lessor that it has done so), its cure period will be extended for as long as reasonably necessary for it to diligently pursue the cure to completion; (ii) if such Default by Lessee is not a failure to pay Rent and is susceptible of cure by a Qualified Mortgagee but cannot reasonably be cured until the Qualified Mortgagee obtains possession of the Premises, then so long as any Qualified Mortgagee commences to obtain possession of the Premises within such 30-day period (and notifies Lessor that it has done so), its cure period will be extended for as long as reasonably necessary for it to obtain possession of the Premises and then promptly commence and thereafter diligently pursue the cure to completion.

Qualified Mortgagees’ Cure Rights. Prior Each Qualified Mortgagee shall have the absolute right to substitute itself for Xxxxxx and perform the duties of Lessee hereunder, including for purposes of curing any default or alleged default by Xxxxxx, including any uncured Default by Xxxxxx (as defined below). As a precondition to exercising any rights or remedies as a result of any default or alleged default by Xxxxxx, Lessor shall deliver a duplicate copy of the applicable default notice to each Qualified Mortgagee concurrently with delivery of such notice to Lessee. In the event of an uncured Default by Lessee after delivery of such notice and the expiration of Lessee’s cure period, but prior to terminating this Lease or exercising any other right or remedy hereunder for a Default by Xxxxxx, Lessor will give each Qualified Mortgagee notice of such Default by Lessee Lessee, and afford it a period of 30 of: (a) Thirty (30) days after such notice is given in which to cure such Default by LesseeLessee if such Default by Lessee is a failure to pay Rent; or (b) Sixty (60) days after such notice is given in which to cure such Default by Lessee if such Default by Lessee is not a failure to pay Rent; provided, however, that (i) if such Default by Lessee is not a failure to pay Rent and is susceptible of cure by a Qualified Mortgagee Mortgagee, but cannot reasonably be cured within such 3060-day period, then so long as any Qualified Mortgagee commences a cure within such 3060-day period (and notifies Lessor that it has done so), its cure period will be extended for as long as reasonably necessary for it to diligently pursue the cure to completion; (ii) . However, if such Default by Lessee is not a failure to pay Rent and is susceptible of cure by a Qualified Mortgagee Mortgagee, but cannot reasonably be cured until the Qualified Mortgagee obtains possession of the PremisesLand, then so long as any Qualified Mortgagee commences to obtain possession of the Premises Land within such 3060-day period (and notifies Lessor that it has done so), its cure period will be extended for as long as reasonably necessary for it to obtain possession of the Premises Land, and then promptly commence and thereafter diligently pursue the cure to completion. If a Qualified Mortgagee is prohibited by any process or injunction issued by any court or by reason of any action of any court having jurisdiction over any bankruptcy or insolvency proceeding involving Lessee from commencing or prosecuting the proceedings described above, then the 60-day period specified above for commencing such proceedings shall be extended for the period of such prohibition.
