Qualified Sales Leads. (i) Each Lead that purchases Company’s Products (including by enrolling in Company’s services) as a result of Slingshot’s Services under this Agreement is referred to herein as a “Qualified Sales Lead.” Slingshot hereby covenants and agrees not to use, solicit or otherwise develop any Qualified Sales Lead for any purpose except for the purpose of performing the Services for Company. For the avoidance of doubt, ▇▇▇▇▇▇▇▇▇ covenants and agrees not to sell or refer any Qualified Sales Lead to any third party without the express written consent of Company. (ii) Any Lead that does not purchase Company’s Products or enroll in Company’s services, including but not limited to Leads that are not eligible to receive Company’s Products or enroll in Company’s services due to the Lead’s location, Company’s service limitations, or any other reason, is referred to herein as an “Unqualified Lead.” Company hereby acknowledges and agrees that ▇▇▇▇▇▇▇▇▇ may use, solicit, or otherwise develop any Unqualified Lead for any purpose, in Slingshot’s sole discretion, including by sharing Unqualified Lead information with other clients or partners of ▇▇▇▇▇▇▇▇▇ for their marketing efforts. Company shall have no responsibility or liability for ▇▇▇▇▇▇▇▇▇’s use of any Unqualified Lead once Slingshot determines that the Lead is an Unqualified Lead.
Qualified Sales Leads. 2.1 A qualified lead is a sales lead received through a TC website which has been verbally confirmed by TC to be genuine and that all contact details and company information is correct. TC does not guarantee that a sales lead will result in a sale.
2.2 TC performs a number of quality checks but does not perform company background or credit checks and does not require the contact to be a decision maker.
2.3 TC will proactively promote the Suppliers products and services to targeted TC visitors, this may include visitors who are primarily interested in other products or services. Leads generated in this way will be marked as Cross Sale and subject to the standard qualifications criteria.
2.4 To receive qualified leads the Supplier must be registered with TC and have an active profile with sufficient budget remaining.
2.5 The Supplier will be notified of new lead details via email to the lead email address provided by the Supplier. Lead information is also available in the Supplier Area of the TC website and can be viewed at any time. TC accepts no responsibility for failure to deliver emails due to junk mail settings or any other problems with, or settings of the Suppliers email system, ISP, computers or servers.
2.6 It is the Supplier’s responsibility to act upon new leads promptly; TC cannot guarantee that leads will result in sales but a prompt response may help win the opportunity.
2.7 Where correct contact details have been provided TC cannot be held responsible for failure to contact sales leads, as with all sales leads persistence and tenacity is required from the Supplier.
2.8 Where the Supplier believes the lead is not genuine or relevant to their business, they may request an alternative lead within 24 hours of receiving the lead. Alternative leads are provided at the discretion of TC.
2.9 TC will not credit or offer an alternative lead where the supplier is already in contact with a customer or has received the same sales lead from another party. TC will make every effort at the point of qualification to ensure that the customer is not already in contact with the Supplier.
2.10 TC will not charge for duplicate leads where the same Customer has requested a quotation through TC in the previous three months.
