Common use of QUALIFIED SUCCESSOR ENTITY SUBSTITUTED Clause in Contracts

QUALIFIED SUCCESSOR ENTITY SUBSTITUTED. At the effective time of any Business Combination Event that complies with Section 6.01, the Qualified Successor Entity (if not the Company) will succeed to, and may exercise every right and power of, the Company under this Indenture and the Notes with the same effect as if such Qualified Successor Entity had been named as the Company in this Indenture and the Notes, and, except in the case of a lease, the predecessor Company will be discharged from its obligations under this Indenture and the Notes.
