Common use of Ratification and operation Clause in Contracts

Ratification and operation. (1) The State shall introduce and sponsor a Xxxx in the Parliament of Western Australia to ratify this Agreement and endeavour to secure its passage as an Act prior to 11 December 1992 or such later date as the parties may agree. (2) The provisions of this Agreement other than this clause 3 shall not come into operation until the Xxxx referred to in subclause (1) has been passed by the Parliament of Western Australia and the provisions of that Xxxx ratifying this Agreement come into operation as an Act. (3) If before 11 December 1992 or such later date as may be agreed pursuant to subclause (1) the provisions of the Xxxx referred to in that subclause ratifying this Agreement have not commenced to operate as an Act then unless the parties otherwise agree this Agreement shall then cease and terminate and none of the parties shall have any claim against any of the others of them with respect to any matter or thing antecedent to, or arising out of or done, performed, or omitted to be done or performed, under this Agreement. (4) On the provisions of the Xxxx referred to in subclause (1) ratifying this Agreement commencing to operate as an Act this Agreement shall operate and take effect.
