Rating Agency Confirmations and Related Expenses. In no event shall the Primary Servicer be permitted to waive any provision of the Mortgage Loan Documents that require a Rating Agency Confirmation as a condition to any action proposed by the related Borrower, or any obligation of a Borrower to pay all or any portion of any fee payable in connection with obtaining a Rating Agency Confirmation, in each case unless the Master Servicer would be permitted to grant such waiver under the terms of the Pooling and Servicing Agreement.
