Real Estate Tax PILOT Guaranty. Wichita GP irrevocably and unconditionally guarantees and covenants that the Apartment Complex shall be eligible for a PILOT payment related to the payment of real estate taxes (other than the real estate taxes attributable to the Land only). If and to the extent that the Partnership has an Operating Deficit due to a requirement to pay real estate taxes (in excess of the PILOT and other than the real estate taxes attributable to the Land) with respect to the Apartment Complex, Wichita GP shall make an Operating Deficit Loan to the Partnership in an amount sufficient to pay such real estate taxes. The foregoing is referred to hereinafter as the "Real Estate Tax PILOT Guaranty." Notwithstanding any statement herein to the contrary, Wichita GP's obligation to make Operating Deficit Loans pursuant to the Real Estate Tax PILOT Guaranty under this paragraph is not subject to the ODG Cap or any other restriction related to the obligation to make Operating Deficit Loans.

Indicating; every person, partnership, limited liability company, association or corporation furnishing labor or material in the repair, alteration, improvement, erection, or construction of any public improvement shall sign a certified statement which will accompany the contract. The certified statement shall state that all equipment to be used on the project, except that acquired since the assessment date, has been assessed for taxation for the current year, giving the county where assessed.
