Recitals and Monitoring Sample Clauses

Recitals and Monitoring. The Trustee shall not be responsible for the execution, effectiveness, adequacy or enforceability of the Trust Deed or the Agency Agreement, and shall not be responsible for (or for investigating any matter which is the subject of) any recital, statement, representation, warranty or covenant of any person contained in this Trust Deed, or otherwise in respect of or in relation to this Trust Deed or any other agreement or document relating to the transactions herein or therein contemplated nor shall the Trustee be under any obligation to monitor or supervise the functions of any other person under this Trust Deed or any other agreement or document relating to the transactions herein or therein contemplated and shall be entitled, in the absence of actual knowledge of a breach of obligation, to assume that each such person is properly performing and complying with its obligations.
