Common use of Recitals by Company Clause in Contracts

Recitals by Company. The recitals in this Fourth Supplemental Indenture are made by the Company only and not by the Trustee, and all of the provisions contained in the Original Indenture in respect of the rights, privileges, immunities, powers and duties of the Trustee shall be applicable in respect of Series F Notes and of this Fourth Supplemental Indenture as fully and with like effect as if set forth herein in full.

Recitals by Company. The recitals in this Fourth Supplemental Indenture are made by the Company only and not by the Trustee, and all of the provisions contained in the Original Indenture in respect of the rights, privileges, immunities, powers and duties of the Trustee shall be applicable in respect of Series F Senior Insured Quarterly Notes and of this Fourth Supplemental Indenture as fully and with like effect as if set forth herein in full.

The recitals in this Fourth Supplemental Indenture are made by the Company only and not by the Trustee, Registrar, Transfer Agent or Paying Agent and all of the provisions contained in the Original Indenture and the Paying Agency Agreement in respect of the rights, privileges, immunities, powers and duties of the Trustee Trustee, Registrar, Transfer Agent and Paying Agent shall be applicable in respect of Series F the Notes and of this Fourth Supplemental Indenture as fully and with like effect as if set forth herein in full.
