Common use of Recommencement of Operations Clause in Contracts

Recommencement of Operations. If Gaming on the Property is prohibited by Legal Requirements or is otherwise impossible or impractical, Manager shall have the option, at its sole discretion, to continue its interest in this Agreement and to commence or recommence the operation of Gaming if, at some point during the Term, such commencement or recommencement shall be legally and commercially feasible in the sole judgment of Manager (the “Recommencement”).

If Gaming on the Property is prohibited by Legal Requirements or is otherwise impossible or impracticalRequirements, Manager shall have the option, at its sole discretion, option to continue its interest in this Agreement and and, with the approval of the Tribe, to commence or recommence the operation of Gaming at the Facility if, at some point during the TermTerm of this Agreement, such commencement or recommencement shall be legally and commercially feasible in the sole judgment of Manager (the “Recommencement”)feasible.
