Common use of Recourse by Tenant Clause in Contracts

Recourse by Tenant. Anything in this Lease to the contrary notwithstanding, Tenant agrees that it shall look solely to the estate and property of Landlord in the land, Building and Improvements thereto, and subject to prior rights of any mortgagee, for the collection of any judgment (or other judicial process) requiring the payment of money by Landlord in the event of any default or breach by Landlord with respect to any of the terms, covenants, and conditions of this Lease to be observed and/or performed by Landlord, and no other assets of Landlord or any of its partners, shareholders, successors, or assigns shall be subject to levy, execution, or other procedures for the satisfaction of Tenant’s remedies.

Recourse by Tenant. Anything in this Lease to the contrary notwithstanding, Tenant agrees that it shall look solely to the estate and property of Landlord in the land, Building Buildings and Improvements thereto, and subject to prior rights of any mortgagee, for the collection of any judgment (or other judicial process) requiring the payment of money by Landlord in the event of any default or breach by Landlord with respect to any of the terms, covenants, and conditions of this Lease to be observed and/or performed by Landlord, and no other assets of Landlord or any of its partners, shareholders, successors, or assigns shall be subject to levy, execution, or other procedures for the satisfaction of Tenant’s 's remedies.

Recourse by Tenant. Anything in this Lease to the contrary notwithstanding, Tenant agrees that it shall look solely to the estate and property of Landlord in the land, Building land and Improvements theretobuilding comprising the Shopping Center, and subject to prior rights of any mortgageemortgagee or beneficiary of any trust deed of the Shopping Center or any part thereof, for the collection of any judgment (or other judicial process) requiring the payment of money by Landlord in the event of any default or breach by Landlord with respect to any of the terms, covenants, and conditions of this Lease to be observed and/or performed by Landlord, and no other assets of Landlord or any of its partners, shareholders, successors, or assigns shall be subject to levy, execution, or other procedures for the satisfaction of Tenant’s remedies.

Recourse by Tenant. Anything in this Lease to the contrary notwithstanding, notwithstanding Tenant agrees that it shall look solely to the estate and property of Landlord in the landshall, Building and Improvements thereto, and subject to prior rights of any mortgageemortgagee in any portion of the Building, look solely in the equity interest of Landlord in this specific/individual parcel of land and Building, for the collection of any judgment (or other judicial process) requiring the payment of money by Landlord in the event of any default or breach by Landlord with respect to any of the terms, covenants, covenants and conditions of this Lease to be observed and/or performed by Landlord, Landlord and no other assets of Landlord or any of its partners, shareholders, successors, or assigns shall be subject to levy, execution, execution or other procedures process for the satisfaction of Tenant’s remedies.

Recourse by Tenant. Anything in this Lease to the contrary notwithstanding, Tenant agrees that it shall look solely to the estate and property equity of Landlord in the land, Building and Improvements theretothe land serving the Building, and subject to the prior rights of the holder of any mortgageemortgage or deed of trust, for the collection of any judgment (or other judicial process) requiring the payment of money by Landlord in the event of on any default or breach by Landlord with respect to any of the terms, covenants, covenants and conditions condi-tions of this Lease to be observed and/or or performed by Landlord, and no other assets asset of Landlord or any of its partners, shareholders, successors, or assigns other person shall be subject to levy, execution, execution or other procedures procedure for the satisfaction of Tenant’s 's remedies.

Tenant agrees that it shall look solely to the estate and property equity of Landlord in the landBuilding in which the Premises is located and the Parcel upon which the Building is situated, Building and Improvements thereto, and subject to prior rights of any mortgageemortgagee (including mortgagees advancing monies after the data of this Lease), for the collection of any judgment (or other judicial process) requiring the payment of money by Landlord in the event of any default or breach by Landlord with respect to any of the terms, covenants, covenants and conditions of this Lease to be observed and/or performed by Landlord, and no other assets of Landlord or any of its partners, shareholders, successors, or assigns shall be subject to levy, execution, execution or other procedures for the satisfaction of Tenant’s remedies.
