The ratio, expressed as a percentage, of (i) Indebtedness of the Consolidated Group that is Recourse (excluding the Indebtedness under this Agreement and the Loan Documents) to (ii) Total Asset Value shall not exceed ten percent (10%) as of the end of the most recently ended fiscal quarter.
