Recourse to Bank Guarantee. Aurizon Network may only draw on the Bank Guarantee in circumstances where: (a) the Study Funder fails to pay any amount that is payable by the Study Funder to Aurizon Network under this Agreement; or (b) where this Agreement otherwise gives Aurizon Network the express right to draw on the Bank Guarantee.
