Common use of Recovery of Litigation Costs Clause in Contracts

Recovery of Litigation Costs. If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover as an element of their damages, reasonable attorneys' fees and other costs incurred in that action or proceeding, in addition to any other relief to which they may be entitled.

Recovery of Litigation Costs. If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover as an element of their damages, reasonable attorneys' fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

If In any legal action or any action, arbitration or other alternate dispute resolution proceeding is brought for the enforcement of based upon or concerning this Agreement, or because of an alleged dispute, breach, default or misrepresentation in connection with any of the provisions of this Agreementagreement, the successful or prevailing party or parties shall be entitled to recover as an element of their damages, reasonable attorneys' its actual attorney fees and other costs incurred in that action or proceeding, in addition to any all other relief to which they may be it is entitled, regardless of whether the proceeding is concluded by settlement, award or judgment.
