Recreational Facility. Guest is required to adhere to Pool Rules provided and posted in the recreation building. Children twelve & under must be accompanied by an adult. RV’s, Boats, Trailers, Tents –are not permitted anywhere within the OVR property. Daily / Weekly stays (less than 28 days) – early departure - no refund. Monthly stays - 30 days’ notice required.
Recreational Facility. Seller shall construct a recreational facility, as described in the plans therefor included in the Project Documents, upon the issuance of a building permit for the 351st dwelling unit in the Paradise Valley development (exclusive of any building permits for the NCROC project). Buyer shall provide Seller quarterly reports indicating the number of closings in any given quarter to facilitate Seller's compliance with this requirement.
Recreational Facility. Pursuant to that certain Development Agreement dated August 11, 1988, as amended, including, without limitation, that certain Second Amendment dated November 3, 1994 (collectively, the "Development Agreement"), Seller is obligated to construct a recreational facility (the "Facility") for the use and benefit of the Paradise Valley development, including, without limitation, the Property, upon the issuance of a building permit for the 351st dwelling unit in the Paradise Valley development (exclusive of any building permits for the NCROC project). Seller hereby agrees to construct the Facility in accordance with the Development Agreement. Buyer agrees to provide Seller with quarterly reports indicating the number of closings in any given quarter to facilitate Seller's compliance with this requirement.
