Common use of Reference to and Effect on the Loan Agreement Clause in Contracts

Reference to and Effect on the Loan Agreement. (a) Upon the effectiveness of Section 1 hereof, each reference in the Loan Agreement to “this Agreement”, “hereunder”, “hereof”, “herein” or words of like import shall mean and be a reference to the Loan Agreement as amended hereby. (b) The Loan Agreement, as amended hereby, and all other documents, instruments and agreements executed and/or delivered in connection therewith, shall remain in full force and effect until hereafter terminated in accordance with their respective terms, and the Loan Agreement and such documents, instruments and agreements are hereby ratified and confirmed. (c) Except as expressly provided herein, the execution, delivery and effectiveness of this Amendment shall not operate as a waiver of any right, power or remedy of the Administrative Agent, any Agent or any Lender, nor constitute a waiver of any provision of the Loan Agreement or any other documents, instruments and agreements executed and/or delivered in connection therewith.

(c) Except as expressly provided herein, the 4.3 The execution, delivery and effectiveness of this Amendment shall not operate as a waiver of any right, power or remedy of the Administrative Agent, any Agent the Conduit or the Committed Lender under the Loan Agreement, the other Loan Documents or any Lenderother document, instrument, or agreement executed in connection therewith, nor constitute a waiver of any provision of the Loan Agreement or any other documents, instruments and agreements executed and/or delivered in connection therewithcontained therein.

(b) Upon the effectiveness of this Amendment, each reference in the Loan Agreement to "this Agreement," "hereunder," "hereof," "herein," or words of like import shall mean and be a reference to the Loan Agreement as amended hereby, and each reference to the Loan Agreement in any other documentsdocument, instruments and agreements instrument or agreement executed and/or delivered in connection therewithwith the Loan Agreement shall mean and be a reference to the Loan Agreement as amended hereby. (c) Except as specifically amended hereby, the Loan Agreement and any other document, instrument or agreement executed in connection therewith shall remain in full force and effect and are hereby ratified and confirmed.

Reference to and Effect on the Loan Agreement. (a) Upon the effectiveness of Section 1 hereofAmendment No. 2 Effective Date, each reference in the Loan Agreement to “this Agreement”, “hereunder”, “hereof”, “herein” ”, or words of like import import, and each reference to the Loan Agreement in any other Loan Document shall mean and be deemed a reference to the Loan Agreement as amended hereby. (b) The Each Loan Agreement, as amended hereby, Document and all other documents, instruments and agreements executed and/or delivered in connection therewith, therewith shall remain in full force and effect until hereafter terminated in accordance with their respective terms, and the Loan Agreement and such documents, instruments and agreements are hereby ratified and confirmed. (c) Except as expressly provided hereinwith respect to the subject matter hereof or otherwise confirmed specifically in writing, the execution, delivery and effectiveness of this Amendment shall not operate as a waiver of any right, power or remedy of JBIC or the Administrative Agent, any Agent or any LenderBorrower, nor constitute a waiver thereby of any provision of the Loan Agreement Agreement, the Loan Documents or any other documents, instruments and agreements executed and/or delivered in connection therewith, which shall remain unchanged and binding on such parties. (d) This Amendment is a Loan Document under (and as defined in) the Loan Agreement.

Reference to and Effect on the Loan Agreement. (al) Upon the effectiveness of Section 1 hereof, each reference in the Loan Agreement to “this Agreement”, “hereunder”, “hereof”, “herein” or words of like import shall mean and be a reference to the Loan Agreement as amended hereby. (bm) The Loan Agreement, as amended hereby, and all other documents, instruments and agreements executed and/or delivered in connection therewith, shall remain in full force and effect until hereafter terminated in accordance with their respective terms, and the Loan Agreement and such documents, instruments and agreements are hereby ratified and confirmed. (cn) Except as expressly provided herein, the execution, delivery and effectiveness of this Amendment shall not operate as a waiver of any right, power or remedy of the Administrative Agent, any Agent or any Lender, nor constitute a waiver of any provision of the Loan Agreement or any other documents, instruments and agreements executed and/or delivered in connection therewith.

Reference to and Effect on the Loan Agreement. (b) Upon the effectiveness of this Amendment, each reference in the Loan Agreement to "this Agreement," "hereunder," "hereof," "herein," or words of like import shall mean and agreements be a reference to the Loan Agreement as amended hereby, and each reference to the Loan Agreement in any other document, instrument or agreement executed and/or delivered in connection therewithwith the Loan Agreement shall mean and be a reference to the Loan Agreement as amended hereby. (c) Except as specifically amended hereby, the Loan Agreement and any other document, instrument or agreement executed in connection therewith shall remain in full force and effect and are hereby ratified and confirmed.

Reference to and Effect on the Loan Agreement. (b) The 7.2 Except as specifically provided herein, the Loan Agreement, as amended hereby, the other Loan Documents and all other documents, instruments and agreements executed and/or delivered in connection therewith, therewith shall remain in full force and effect until hereafter terminated in accordance with their respective terms, and the Loan Agreement and such documents, instruments and agreements are hereby ratified and confirmed. (c) Except as expressly provided herein, the 7.3 The execution, delivery and effectiveness of this Termination and Amendment shall not operate as a waiver of any right, power or remedy of the Administrative Agent, any Agent or the Lender under the Loan Agreement, the other Loan Documents or any Lenderother document, instrument or agreement executed in connection therewith, nor shall it constitute a waiver of any provision of the Loan Agreement or any other documents, instruments and agreements executed and/or delivered in connection therewithcontained therein.

Reference to and Effect on the Loan Agreement. Reference to and Effect on the Loan Agreement. (b) The Each Loan Agreement, as amended hereby, Document and all other documents, instruments and agreements executed and/or delivered in connection therewith, therewith shall remain in full force and effect until hereafter terminated in accordance with their respective terms, and the Loan Agreement and such documents, instruments and agreements are hereby ratified and confirmed. (c) Except as expressly provided hereinwith respect to the subject matter hereof or otherwise confirmed specifically in writing, the execution, delivery and effectiveness of this Amendment shall not operate as a waiver of any right, power or remedy of JBIC or the Administrative Agent, any Agent or any LenderBorrower, nor constitute a waiver thereby of any provision of the Loan Agreement Agreement, the Loan Documents or any other documents, instruments and agreements executed and/or delivered in connection therewith, which shall remain unchanged and binding on such parties. (d) This Amendment is a Loan Document under (and as defined in) the Loan Agreement.
