Common use of Reference to and Effect on the Purchase Agreement Clause in Contracts

Reference to and Effect on the Purchase Agreement. (a) On and after the Amendment Effective Date, each reference in the Existing Purchase Agreement to “this Agreement”, “hereunder”, “hereof” or words of like import referring to the Existing Purchase Agreement shall mean and be a reference to the Existing Purchase Agreement as amended by this Amendment. (b) The Existing Purchase Agreement, as amended by this Amendment, is and shall continue to be in full force and effect and is hereby in all respects ratified and confirmed. (c) The execution, delivery and effectiveness of this Amendment shall not, except as expressly provided herein, operate as a waiver of any right, power or remedy of the Purchaser under the Purchase Agreement, nor constitute a modification, acceptance or waiver of any other provision of the Purchase Agreement.

Reference to and Effect on the Purchase Agreement. (a) i. On and after the Amendment Effective Datedate hereof, each reference in the Existing Purchase Agreement to “"this Agreement”", “"hereunder”", “"hereof” ", "herein" or words of like import in the Existing Loan Documents referring to the Existing Purchase Agreement Agreement, shall mean and be a reference to the Existing Purchase Agreement as amended by this Amendment. (b) The Existing Purchase Agreement, as amended by this Amendment. ii. Except as specifically amended by this Amendment, is the Purchase Agreement and the other Existing Loan Agreements shall continue to be remain in full force and effect and is are hereby in all respects ratified and confirmed. (c) iii. The execution, delivery and effectiveness performance of this Amendment shall not, except as expressly provided herein, constitute a waiver of any provision of, or operate as a waiver of any right, power or remedy of the Purchaser Lender under the Purchase Agreement, nor constitute a modification, acceptance Agreement or waiver of any other provision of the Purchase Agreementother Existing Loan Agreements.
