Common use of Reference to and Effect on the Purchase Agreement Clause in Contracts

Reference to and Effect on the Purchase Agreement. (a) Upon the effectiveness of this Amendment, on and after the date hereof each reference in the Purchase Agreement to "this Agreement", "hereunder", "hereof' or words of like import referring to the Purchase Agreement, and each reference in any other document to "the Purchase Agreement", "thereunder", "thereof' or words of like import referring to the Purchase Agreement, shall mean and be a reference to the Purchase Agreement, as amended hereby. (b) Except as specifically amended above, the Purchase Agreement, and all other related documents, are and shall continue to be in full force and effect and are hereby in all respects ratified and confirmed. (c) The execution, delivery and effectiveness of this Amendment shall not, except as expressly provided herein, operate as a waiver of any right, power or remedy of any holder of a Note under the Purchase Agreement or the Notes, nor constitute a waiver of any provision of any of the foregoing.

(bii) Except as specifically amended aboveby this Tenth Amendment, the Purchase Agreement, and all other related documents, are and Agreement shall continue to be remain in full force and effect and are is hereby in all respects ratified and confirmed. (ciii) The execution, delivery and effectiveness performance of this Tenth Amendment shall not, except as expressly provided herein, constitute a waiver of any provision of, or operate as a waiver of any right, power or remedy of any holder of a Note under the Holders under, the Purchase Agreement or the Notes, nor constitute a waiver of any provision of any of the foregoingAgreement.
