Reference to the SPA Sample Clauses
Reference to the SPA. Any and all notices, requests, certificates and other documents or instruments executed and delivered concurrently with or after the execution and delivery of this First Amendment may refer to the SPA without making specific reference to this First Amendment, but all such references shall be deemed to include this First Amendment, unless the context shall otherwise require.
Reference to the SPA. On and after the date hereof, each reference in the SPA to “this Agreement,” “hereof,” “herein,” “herewith,” “hereunder” and words of similar import shall, unless otherwise stated, be construed to refer to the SPA as amended by this Amendment. No reference to this Amendment need be made in any instrument or document at any time referring to the SPA and a reference to the SPA in any such instrument or document shall be deemed to be a reference to the SPA as amended by this Amendment.
Reference to the SPA. Except as otherwise expressly provided herein, the Parties hereby agree that the SPA shall continue to be in full force and effect and is hereby ratified and confirmed in all respects. Neither this Amendment nor any provision herein shall operate as a waiver or consent to any past, present or future breach of any provision of the SPA.
