Common use of Refunding Documents Clause in Contracts

Refunding Documents. This Agreement and the following documents shall have been duly authorized, executed and delivered by the respective party or parties thereto, shall, to the extent that the forms thereof are not attached hereto, each be satisfactory in form and substance to the Lessee, the Indenture Trustee, the Pass Through Trustee, the Owner Trustee and the Owner Participant (each acting directly or by authorization to its special counsel) and shall each be in full force and effect; there shall not have occurred any default thereunder, or any event which with the lapse of time or the giving of notice or both would be a default thereunder, and copies executed or certified as requested by the Lessee, the Owner Trustee, the Owner Participant, the Indenture Trustee or the Pass Through Trustee, as the case may be, of such documents shall have been delivered to the Lessee, the Owner Participant, the Indenture Trustee, the Pass Through Trustee and the Owner Trustee (provided that the sole chattel-paper original of the Lease shall be delivered to the Indenture Trustee) :
