Common use of Refusal to issue Permits Clause in Contracts

Refusal to issue Permits. In case of conflict with any bona fide municipal purpose, including reasons of public safety and health, conflicts with existing infrastructure, proposed road construction, or the proper functioning of public services, all as identified in writing to the Company by the Municipality, the Municipality may request amendments to the plans referred to in Section 3.4 or may choose to refuse to issue a Permit in accordance with Section 3.1.

In case of conflict with any bona fide municipal purpose, including reasons of public safety and health, conflicts with existing infrastructure, proposed road construction, or the proper functioning of public services, all as identified in writing to the Company by the Municipality, the Municipality may request amendments to the plans referred to in Section 3.4 3.3 or may choose to refuse to issue a Permit in accordance with Section 3.1.3.1.‌

The Municipality shall make good faith effort to provide consent to alternative suggestions, wherever possible, for routing the Equipment Within the ROW to assist the Company in Section 3.4 or may choose its efforts to refuse to issue a Permit in accordance with Section 3.1facilitate the installation of its Equipment.
