Common use of Regulatory Enforcement Actions Clause in Contracts

Regulatory Enforcement Actions. Except as set forth in Section 4.7.2 of the Disclosure Schedule, none of Borrower, any Subsidiary or any of their respective officers or directors is now operating under any restrictions, agreements, memoranda, or commitments (other than restrictions of general application) imposed by any Governmental Agency, nor are any such restrictions threatened or agreements, memoranda or commitments being sought by any Governmental Agency.

Regulatory Enforcement Actions. Except as set forth in Section 4.7.2 4.7.3 of the Disclosure Schedule, none of Borrower, any Subsidiary or any of their respective officers or directors is now operating under any restrictions, agreements, memoranda, or commitments (other than restrictions of general application) imposed by any Governmental Agency, nor nor, to Borrower’s knowledge, are any such restrictions threatened or agreements, memoranda or commitments being sought by any Governmental Agency.
