Common use of Reimbursement and recovery Clause in Contracts

Reimbursement and recovery. 1. If any amount is unduly paid to a beneficiary or if recovery is justified under the terms of the grant agreement, the beneficiary undertakes to repay the JU via the coordinator the sum in question following a written request by the JU. Where, following this written request from the JU, a beneficiary in an on-going grant agreement does not reimburse to the coordinator any requested amount at the latest 30 days after receipt of the request, the JU may recover the amount due from that beneficiary by any appropriate means, including invoking any guarantees. No prior consent of the beneficiary is required. 2. If the obligation to pay the amount due is not honoured by the date set by the JU, the sum due shall bear interest at the rate indicated in Article II.
