Common use of Reimbursement of Grants Clause in Contracts

Reimbursement of Grants. Subject to Section 801 (Remedies) below, Redeveloper agrees to repay the City for the aid to construction and any grant or grants of funds to Redeveloper as provided for in Section 503 A. (Use of TIF Proceeds) and Section 506 A. (Grant of Funds) above in the event Redeveloper fails to substantially complete the Redeveloper Improvements as provided in Section 202 B. (Commencement and Completion Deadline for Redeveloper Improvements) above and, upon such repayment of the of the grant funds, this Redevelopment Agreement shall be null and void in regards to Redeveloper’s obligation to construct the Redeveloper Improvements located upon the Project Site. Subject to Section 801 (Remedies) below, in the event Redeveloper fails to maintain the Redeveloper Improvements as provided in Section 205 (Duty to Maintain) above, then said Redeveloper shall reimburse the City 1/15 of the grant funds granted to Redeveloper for construction of the Redeveloper Improvements as provided for in Section 506 A. (Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Improvements.

Subject to Section 801 901 (Remedies) below, in the event Redeveloper fails to maintain the Redeveloper Private Improvements as provided in Section 205 307 (Duty to Maintain) above, then said Redeveloper shall reimburse the City 1/15 of the grant funds granted to Redeveloper for construction of the Redeveloper Private Improvements as provided for in Section 506 A. 606 A (Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Private Improvements.

(Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Private Improvements.

(Commencement and Completion Deadline for Redeveloper Improvements) above and, upon such repayment of the of the grant funds, this Redevelopment Agreement shall be null and void in regards with regard to Redeveloper’s obligation to construct the Redeveloper Improvements located upon the Project Site. Subject to Section 801 (Remedies) below, in the event Redeveloper fails to maintain the Redeveloper Improvements as provided in Section 205 207 (Duty to Maintain) above, then said Redeveloper shall reimburse the City 1/15 of the grant funds granted to Redeveloper for construction of the Redeveloper Improvements as provided for in Section 506 A. 506A. (Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Improvements.

Subject to Section 801 901 (Remedies) below, in the event Redeveloper fails to maintain the Redeveloper Private Improvements as provided in Section 205 306 (Duty to Maintain) above, then said Redeveloper shall reimburse the City 1/15 of the grant funds granted to Redeveloper for construction of the Redeveloper Private Improvements as provided for in Section 506 A. 605.A. (Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Private Improvements.

Subject to Section 801 901 (Remedies) below, in the event Redeveloper fails to maintain the Redeveloper Private Improvements as provided in Section 205 305 (Duty to Maintain) above, then said Redeveloper shall reimburse the City 1/15 1/20 of the grant funds granted to Redeveloper for construction of the Redeveloper Private Improvements as provided for in Section 506 607 A. (Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Private Improvements.

(Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Private Improvements.

Subject to Section 801 1001 (Remedies) below, in the event Redeveloper fails to maintain the Redeveloper Private Improvements as provided in Section 205 305 (Duty to Maintain) above, then said Redeveloper shall reimburse the City 1/15 of the grant funds granted to Redeveloper for construction of the Redeveloper Private Improvements as provided for in Section 506 A. 705 A (Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Private Improvements.

(Use of TIF Proceeds) and Section 506 406 A. (Grant of Funds) above in the event Redeveloper fails to substantially complete the Redeveloper Improvements as provided in Section 202 B. (Commencement and Completion Deadline for Redeveloper Improvements) above and, upon such repayment of the of the grant funds, this Redevelopment Agreement shall be null and void in regards to Redeveloper’s obligation to construct the Redeveloper Improvements located upon the Project Site. Subject to Section 801 (Remedies) below, in the event Redeveloper fails to maintain the Redeveloper Improvements as provided in Section 205 (Duty to Maintain) above, then said Redeveloper shall reimburse the City 1/15 of the grant funds granted to Redeveloper for construction of the Redeveloper Improvements as provided for in Section 506 406 A. (Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Improvements.

Subject to Section 801 (Remedies) below, in the event Redeveloper fails to maintain the Redeveloper Improvements New Building as provided in Section 205 306 (Duty to Maintain) above, then said Redeveloper shall reimburse the City 1/15 of the grant funds granted to Redeveloper for construction of the Redeveloper Private Improvements as provided for in Section 506 507 A. (Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Private Improvements.

Subject to Section 801 (Remedies) below, in the event Redeveloper fails to maintain the Redeveloper Improvements as provided in Section 205 311 (Duty to Maintain) above, then said Redeveloper shall reimburse the City 1/15 1/15th of the grant funds granted to Redeveloper for construction of the Redeveloper Improvements as provided for in Section 506 507 A. (Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Improvements.

Subject to Section 801 901 (Remedies) below, in the event Redeveloper fails to maintain the Redeveloper Improvements as provided in Section 205 306 (Duty to Maintain) above, then said Redeveloper shall reimburse the City 1/15 1/20th of the grant funds granted to Redeveloper for construction of the Redeveloper Improvements as provided for in Section 506 A. 606A. (Grant of Funds) above, for each year a Redeveloper fails to maintain the Redeveloper Improvements.
