Common use of Reimbursement of Payments Under Letters of Credit Clause in Contracts

Reimbursement of Payments Under Letters of Credit. Borrower shall reimburse Letter of Credit Issuer through Administrative Agent for any payment that Letter of Credit Issuer makes under a Letter of Credit on or before the date of such payment; PROVIDED that if the conditions precedent set forth in SECTION 4 can be satisfied, Borrower may request a Borrowing of Committed Loans to reimburse Letter of Credit Issuer for such payment pursuant to SECTION 2.02, or, failing to make such request, Borrower shall be deemed to have requested a Borrowing of Committed Loans which are Base Rate Loans on such payment date pursuant to subsection (e) below.
