Common use of Reimbursement of Payments Under Letters of Credit Clause in Contracts

Reimbursement of Payments Under Letters of Credit. Each Borrower for whose account a Letter of Credit has been issued shall reimburse Issuing Lender through Administrative Agent for any payment that Issuing Lender makes under a Letter of Credit on or before the date of such payment; provided, however, that if the conditions precedent set forth in Section 4.02 can be satisfied, such Borrower may request a Borrowing of Loans to reimburse Issuing Lender for such payment pursuant to Section 2.02, or, failing to make such request, such Borrower shall be deemed to have requested a Borrowing of Base Rate Loans on such payment date pursuant to subsection (e) below.
