Common use of Reimbursement of Payments Under Letters of Credit Clause in Contracts

Reimbursement of Payments Under Letters of Credit. Borrower shall reimburse Issuing Lender for any payment that Issuing Lender makes under a Letter of Credit on or before the date of such payment; provided, however, that if the conditions precedent set forth in Section 4.02 can be satisfied, Borrower may request a Borrowing of Loans to reimburse Issuing Lender for such payment pursuant to Section 2.03, or, failing to make such request, Borrower shall be deemed to have requested a Borrowing of Base Rate Loans on such payment date pursuant to subsection (e) below.
