Common use of Reinstatement of Guarantee Clause in Contracts

Reinstatement of Guarantee. This Guarantee shall continue to be effective, or be reinstated, as the case may be, if at any time payment, or any part thereof, of any of the Obligations is avoided, rescinded or must otherwise be restored or returned by the Guaranteed Party to the Company or its representative or to any other guarantor for any reason including as a result of any insolvency, bankruptcy or reorganization proceeding with respect to the Company or the Guarantor, all as though such payment had not been made.

Reinstatement of Guarantee. This Guarantee shall continue to be effective, effective or be reinstated, as the case may be, if at any time paymentany payment to Beneficiary by Guarantor hereunder, or any part thereof, of any of the Obligations is avoided, rescinded or must otherwise be restored or returned by Beneficiary upon the Guaranteed Party to the Company or its representative or to any other guarantor for any reason including as a result of any insolvency, bankruptcy bankruptcy, reorganization, dissolution or reorganization proceeding with respect to the Company liquidation of Obligor or the Guarantorotherwise, all as though such payment had not been made. 17.

Reinstatement of Guarantee. This Guarantee shall continue to be effective, effective or be reinstated, as the case may be, if at any time payment, any payment to or any part thereof, on behalf of any of Contractor or to Obligee by Contractor under the Obligations EPC Agreement or by Guarantor hereunder is avoided, rescinded or must otherwise be restored or returned by Obligee upon the Guaranteed Party to the Company or its representative or to any other guarantor for any reason including as a result of any insolvency, bankruptcy bankruptcy, reorganization, dissolution or reorganization proceeding with respect to the Company liquidation of Contractor or the Guarantorotherwise, all as though such payment had not been made.
