REIT STATUS, ETC. The Borrower shall at any time fail to maintain its REIT Status, or the Borrower or any Subsidiary shall lose, through suspension, termination, impoundment, revocation, failure to renew or otherwise, any material license or permit; or

REIT STATUS, ETC. Omega shall at any time fail to maintain its REIT Status, or Omega or any other Borrower shall lose, through suspension, termination, impoundment, revocation, failure to renew or otherwise, any license or permit if such loss could result in a Material Adverse Effect on Omega and its Subsidiaries on a consolidated basis; or
