Common use of Rejection of non Defective Goods Clause in Contracts

Rejection of non Defective Goods. If the Purchaser rejects any Goods which are not defective or seeks to return Goods that are not defective, then the Purchaser must notify TOMRA of their intention to return Goods within (30) calendar days of Delivery and Tomra shall be entitled to invoice the Purchaser a restocking fee which shall be 20% of the Contract Price. The cost of return of the Goods to TOMRA shall be the Purchasers. The Purchaser is not permitted to return Goods which are specifically made to order except in compliance with Clause 3.1 where they are defective.
