Common use of Related Organisations Clause in Contracts

Related Organisations. Related Organisations shall be third party beneficiaries under this Contract and may enforce the terms of this Contract (including the benefit of any indemnity expressed to be in their favour) subject to and in accordance with the provisions of this Contract and the Contracts (Rights of Third Parties) Act 1999. In respect of the Related Organisations: in the event that the Related Organisations do not opt to enforce their rights under clause 64.1 (Related Organisations), the Authority shall be entitled to enforce the terms of this Contract on their behalf and, subject to clause 71 (No Double Recovery), for this purpose the losses of such Related Organisations shall be deemed to be losses of the Authority; and the Authority shall be responsible for ensuring compliance by the Related Organisations with any obligations that relate to use of, access to or receipt of the Services (including as to payment of the Contract Price) and the Contractor shall have no rights, and shall waive any and all such rights, to enforce any provisions in this Contract against the Related Organisations.
