Relation to Townhome Tract. Developer represents and warrants that no infrastructure or other improvements located on the Townhome Tract comprises any portion of the Site Work (except as the FCRHA may approve in writing). For purposes of clarity, the portions of the retaining wall(s) described in the Land Use Approvals and located on the Townhome Tract are not part of the Site Work.
