Common use of Relationship with Third Parties Clause in Contracts

Relationship with Third Parties. The relationship between the parties established by this SaaS Agreement is that of independent contractors, and nothing contained in this SaaS Agreement shall be construed to: (i) give either party the power to direct or control the day-to-day activities of the other; (ii) constitute the parties as partners, joint ventures, co-owners or otherwise as participants in a joint or common undertaking or franchise; (iii) allow Company to create or assume any obligation on behalf of Beyond Identity for any purpose whatsoever; or (iv) allow any Company, End-User, or other person or entity not a party to this SaaS Agreement to be considered a third-party beneficiary of this SaaS Agreement.
