Common use of Release and Waiver of Subrogation Clause in Contracts

Release and Waiver of Subrogation. The Parties release each other, and their respective Landlord’s Agents and Tenant’s Agents, from any liability for any property loss or damage that is caused by or results from any risk insured or which could be insured against under the types of insurance specified in Section 10.1 above; provided, however, the foregoing provisions shall not apply to the third party liability insurance described in Section 10.1 to the extent prohibited by Law. To the extent permitted under Law, each Party shall secure a written waiver of subrogation from its respective insurers under these respective policies.

The Parties Notwithstanding anything to the contrary in this Sublease, the parties hereto release each other, other and their respective Landlord’s Agents agents, employees, successors and Tenant’s Agents, assigns from any all liability for damage to any property loss or damage that is caused actually covered by or results from any risk insured property insurance in force or which could would normally be insured against under the types of insurance specified in Section 10.1 above; providedcovered by full replacement value “Special Form” property insurance, however, the foregoing provisions shall not apply without regard to the third negligence or willful misconduct of the entity so released. Each party liability shall cause each insurance described in Section 10.1 policy it obtains to the extent prohibited by Law. To the extent permitted under Law, each Party shall secure include a written waiver of subrogation from its respective insurers under these respective policiesregarding the liabilities released hereby.
