Release for Cause. 1. A member is considered to be released for cause according to the conditions of the member’s contract. 2. A member will be released for cause if the member is convicted of a violent felony or the sale or distribution of a controlled substance during a term of service. 3. Any member who leaves AmeriCorps service without obtaining a release for compelling personal circumstances is considered to have been released for cause. 4. The member has committed a fourth offense or is otherwise released in accordance with paragraph D of the Rules of Conduct section of this agreement. 5. The member commits any of the acts listed in section E in the Rules of Conduct section above.

Release for Cause. (1) A release for cause encompasses any circumstances other than compelling personal circumstances that warrant an individual's release from completing a term of service. (2) AmeriCorps programs must release for cause any participant who is convicted of a felony or the sale or distribution of a controlled substance during a term of service. (3) A participant who is released for cause may not receive any portion of the AmeriCorps education award or any other payment from the National Service Trust. (4) An individual who is released for cause must disclose that fact in any subsequent applications to participate in an AmeriCorps program. Failure to do so disqualifies the individual for an education award, regardless of whether the individual completes a term of service.
Release for Cause. Members exiting the program for cause will cease to receive the living stipend, the health care benefits and the child care benefits and will receive no portion of their education award. The program will release the Member for cause for the following reasons: • The Member has dropped out of the program without obtaining a release for compelling personal circumstances from the appropriate program official. • During the term of service the Member has been convicted of a violent felony or the sale or distribution of a controlled substance. • The Host Site requests that the Member be terminated from service at the site. • The Member has committed any of the offenses listed below: 1. Engaging in any activity that may physically or emotionally damage other Members of the program or people in the community. 2. Unlawful manufacture, distribution, dispensation, possession or use of any controlled substance or illegal drugs during the term of service. 3. Consuming alcoholic beverages during the performance of service activities. 4. Being under the influence of alcohol or any illegal drugs during the performance of service activities. • Any other serious breach that in the judgement of the Program staff or Host Site would undermine the effectiveness of the program.
Release for Cause. I understand that FoodCorps may release me from the Program for cause in the following circumstances: 1. I fail to report for service for three (3) days or more without obtaining permission or a release for compelling personal circumstances from my Service Site Supervisor; 2. I am convicted, during my term of service, of a violent crime or of any crime involving the manufacture, distribution, dispensation, possession or use of any controlled substance or illegal drug.

This includes both release for misconduct and for a Fellow deciding to leave the program. a. Programs must release for cause any participant who is convicted of a felony or the sale or distribution of a controlled substance during a term of service. b. A Fellow who is released for cause may not receive any portion of the education award or any other payments from College Corps or College Corps partner campuses. c. A Fellow who is released for cause must disclose that fact in any subsequent applications to participate in an College Corps program. Failure to do so disqualifies the individual for an education award, regardless of whether the individual completes a term of service. d. A Fellow who is released for cause may contest the decision by filing a grievance with their campus. Pending the resolution of a grievance procedure filed by an individual to contest a determination by a program to release the individual for cause, the individual's service is considered to be suspended and should not receive any financial benefits. e. An individual's eligibility for a subsequent term of service in College Corps will not be affected by release for cause from a prior term of service so long as the individual received a satisfactory end-of-term performance review for the period served in the prior term. f. For AmeriCorps Fellows: A term of service from which an individual is released for cause counts as one of the maximum 4 terms of service, unless the Fellow is released for reasons other than misconduct prior to completing 15% of a term of service.
Release for Cause. A Release for Cause encompasses circumstances other than personal and compelling that warrant a member’s release before completing their term of service. A member may be Released for Cause for the following reasons (list is not necessarily inclusive): • For violating the Standards of Conduct, expectations contained in this Member Service Agreement, or CLEC policies and procedures. • If a member drops out of the program without obtaining a release for Compelling Personal Circumstances from CLEC staff. If the member is Released for Cause from their term of service, the member will cease to receive the benefits described in this document and will not be eligible to receive a full or partial Education Award. Furthermore, if a member is Released for Cause with Unsatisfactory Performance (defined below), they will not be permitted to serve with AmeriCorps or other national service programs again. Unsatisfactory performance includes but is not limited to violations of the requirements described in this Member Service Agreement, including: • Timekeeping violations, including non-submission, consistently late submissions, and falsifying time reports • Standards of Conduct violations, including improper behavior, failure to notify site staff of intent to be late or absent within 30 minutes of scheduled start time, consistently reporting late to service assignments without adequate cause, or leaving service sites without permission. • Recording Hours violationsProhibited Activities violations • Drug-Free Workplace Act violations • Member Safety violations For serious allegations that require the supervisor and CLEC staff to investigate before determining if the member should be Released for Cause, the member may be suspended for up to 30 days. The supervisor must consult with CLEC Staff before suspending the member. If the final determination is that the member should be Released for Cause, the member will not receive any portion of an education award based on the time served in the program. AmeriCorps CLEC members will be allowed reasonable and appropriate personal time off with the supervisor's prior approval.

For this type of grievance, a program may not - while the grievance is pending or as part of its resolution - provide a participant with federally-funded benefits (including payments from the National Service Trust) beyond those attributable to service actually performed, without the program receiving written approval from the AmeriCorps. An individual's eligibility for a subsequent term of service in AmeriCorps will not be affected by release for cause from a prior term of service so long as the individual received a satisfactory end-of-term performance review as described in § 2522.220(c)(2) for the period served in the prior term. A term of service from which an individual is released for cause counts as one of the maximum 4 terms of service, unless the member is released for reasons other than misconduct prior to completing 15% of a term of service.

A member may be released for cause for failure to follow the standards of behavior as outlined in the Member code of conduct, failure to adhere to program rules and guidelines defined by this member service agreement, or violating the policies or procedures as set forth by the sponsoring agency. The code of conduct specifies particular offenses and the corresponding course of action. 2. The Program will release the member for cause for the following reasons: a. The Member leaves the program to enroll in school b. The Member leaves the program to obtain employment c. The Member leaves the program due to dissatisfaction with the Program. d. The Member has dropped out of the program without obtaining a release for compelling personal circumstances from the appropriate program official. e. During the term of service, the member has been convicted of a violent felony or the sale or distribution of a controlled substance. f. The member has committed another serious breach that, in the judgment of the program director, would undermine the effectiveness of the Program. 3. A member released for cause may not receive any portion of the AmeriCorps Education Award. In addition, any individual released for cause who wishes to reapply to the program from which he/she was released or to any other AmeriCorps program is required to disclose the release to that program. Failure to disclose to an AmeriCorps program any history of having been released for cause from another AmeriCorps program will render an individual ineligible to receive the AmeriCorps education award upon successful completion of the term of service.
