Common use of Release of Funds to Incumbent Clause in Contracts

Release of Funds to Incumbent. Upon receipt by the Escrow Agent of a written joint certification of PathNet and Incumbent substantially in the form attached hereto as Attachment A to the effect that Incumbent is entitled to receive a portion of or all of the PathNet Escrow Deposit in accordance with Section 4.4.4(b) of the FPM Agreement or upon receipt by the Escrow Agent of a court order directing payment to Incumbent of a portion of or all of the PathNet Escrow Deposit, the Escrow Agent shall promptly deliver to Incumbent such portions of or all of the PathNet Escrow Deposit.

Release of Funds to Incumbent. Upon receipt by the Escrow Agent of a written joint certification of PathNet and Incumbent substantially in the form attached hereto as Attachment A B to the effect that Incumbent is entitled to receive a portion of or all of the PathNet Incumbent Escrow Deposit in accordance with Section 4.4.4(b) 4.1.5 of the FPM Agreement or upon receipt by the Escrow Agent of a court order directing payment to Incumbent of a portion of or all of the PathNet Escrow DepositAgreement, the Escrow Agent shall promptly deliver to Incumbent such portions of or all of the PathNet Incumbent Escrow Deposit.

Upon receipt by the Escrow Agent of a written joint certification of PathNet Pathnet and Incumbent substantially in the form attached hereto as Attachment A to the effect that Incumbent is entitled to receive a portion of or all of the PathNet Pathnet Escrow Deposit in accordance with Section 4.4.4(b4.3.4(b) of the FPM Agreement or upon receipt by the Escrow Agent of a court order directing payment to Incumbent of a portion of or all of the PathNet Pathnet Escrow Deposit, the Escrow Agent shall promptly deliver to Incumbent such portions of or all of the PathNet Pathnet Escrow Deposit.
