Common use of Release of Funds to Pathnet Clause in Contracts

Release of Funds to Pathnet. Upon receipt by the Escrow Agent of a written joint certification of PathNet and Incumbent substantially in form attached hereto as Attachment A to the effect that PathNet is entitled to receive a portion of or all of the PathNet Escrow Deposit in accordance with Section 4.3.4(b) of the FPM Agreement, the Escrow Agent shall promptly deliver to PathNet such portions of or all of the PathNet Escrow Deposit.

Release of Funds to Pathnet. Upon receipt by the Escrow Agent of a written joint certification of PathNet Pathnet and Incumbent substantially in form attached hereto as Attachment A to the effect that PathNet Pathnet is entitled to receive a portion of or all of the PathNet Pathnet Escrow Deposit in accordance with Section 4.3.4(b4.2.4(b) of the FPM Agreement, the Escrow Agent shall promptly deliver to PathNet Pathnet such portions of or all of the PathNet Pathnet Escrow Deposit.
