Common use of Releases, Waivers and Remedies Clause in Contracts

Releases, Waivers and Remedies. 19.2.1 The rights, powers and remedies provided in this Agreement are cumulative and not exclusive of any rights, powers and remedies provided by Applicable Law, including any liability for fraud or fraudulent misrepresentation. No delay or omission by any Party in exercising any right, power of remedy provided by Applicable Law or under this Agreement, no failure by either Party to insist on any occasion upon the performance of the terms, conditions and provisions of this Agreement, no time or other indulgence granted by one Party to the other Party will affect that right, power or remedy or operate as a waiver of such breach or acceptance of any variation or the relinquishment of any such right or any other right under this Agreement, which shall remain in full force and effect.
