RELIEF FOR SETTLEMENT CLASS. 4.1. Pursuant to, subject to, and conditioned upon all other terms of this Agreement, and in consideration for the dismissal of the Action with prejudice on the merits and in consideration of the Release and the approval, entry and enforcement thereof by the Court, and provided the Final Judgment and Order is first entered, the Town has agreed to provide Plaintiffs and the Settlement Class with the following relief (and only the following relief), subject to each and all of the terms and conditions specified herein.
