Common use of Remedies for Breach of Agreement Clause in Contracts

Remedies for Breach of Agreement. If Hayden commits a breach or threatens to commit a breach of any of the provisions of this Agreement, Midland shall have the right to have the provisions of this Agreement specifically enforced by any court having equity jurisdiction without having to prove the inadequacy of the available remedies at law or irreparable injury, it being acknowledged and agreed to between Midland and Hayden that any such breach or threatened breach will cause irreparable injury to Midland and that money damages may not provide an adequate remedy to Midland. In addition, Midland may take and pursue all such other actions and remedies as may be available to Midland at law or in equity and shall be entitled to such damages as Midland can show Midland has sustained by reason of such breach, together with court costs and attorneys' fees.
