Common use of Remedies for County's Default Clause in Contracts

Remedies for County's Default. In addition to any other remedies Licensee may have at law or in equity, if the County is in default under this Agreement, Licensee may terminate this Agreement by written notice to the County. The County shall not be deemed in default if the County has initiated appropriate remedial action prior to the notice of termination and diligently pursues that remedial action to completion. In no event shall Licensee be entitled to recover lost profits or consequential damages from the County for a default under this Agreement.
