Common use of Remedies for Noncompliance Clause in Contracts

Remedies for Noncompliance. A. If the Subrecipient fails to comply with Federal statutes, regulations or the terms and conditions of the Subaward, the County may impose additional conditions as set forth in 2 CFR § 200.207. If the County determines that the Subrecipient’s noncompliance cannot be remedied by imposing additional conditions, the County may take one or more of the following actions, as appropriate: 1. Temporarily withhold cash payments pending correction of the deficiency. 2. Disallow (that is, deny both use of funds and any applicable matching credit for) all or part of the cost of the activity or action not in compliance. 3. Wholly or partly suspend or terminate the Subaward. 4. Initiate suspension or debarment proceedings as authorized under 2 CFR part 180. 5. Withhold further federal subawards for the project or program. 6. Take other remedies that may be legally available.
