Common use of Remedies upon Event of Default by Customer Clause in Contracts

Remedies upon Event of Default by Customer. Upon the occurrence of an Event of Default by Customer, UnitedLayer shall have the right (a) to discontinue all Services to Customer with or without notice to Customer, (b) to disconnect Customer from its internet, power and telecommunications services; (c) to remove any Customer equipment from the Data Center and place it in storage at Customer's expense and subject to UnitedLayer’s lien rights, and/or (d) upon written notice to Customer, to terminate the Agreement. In the event this Agreement is terminated for any reason other than an Event of Default by UnitedLayer, Customer shall be obligated to pay to UnitedLayer immediately all amounts due to UnitedLayer, including late charges and fees, plus an amount equal to the total MRC charges that Customer would have paid UnitedLayer over the remainder of the term of the Agreement as specified on each Service Order Form.
