Common use of Remedy for Concurrent Delay Clause in Contracts

Remedy for Concurrent Delay. Contractor’s sole remedy for Excusable Delays satisfying the requirements of Section 13.3.1 that are concurrent delays to the Critical Path shall be an adjustment to the Scheduled Substantial Completion Date in accordance with this Contract. Multiple delays to the Critical Path caused by the same party shall not be considered concurrent delays.
