REMOTE DEPOSIT PROCESS. In order to use Remote deposit, you must obtain and maintain, at your own expense, compatible hardware and software as specified by Ventura County Credit Union from time to time. You are responsible for providing your own hardware and software (“Access Device”) to access the service. You are also responsible for the charges of any wireless network or internet service provider you may utilize in accessing the service. You acknowledge that at any time, the hardware and software you use to access Remote Deposit may be subject to unauthorized tracking, interception, corruption, diversion or other manipulation by “spyware” or other malicious code. We are not responsible for detecting the existence of any such malicious code, or for advising you of its existence or potential effects even if we become aware of it, and your use of your hardware and software to access Remote Deposit is a. The item is eligible for deposit using Remote Deposit; b. The item is not a duplicate of an item previously deposited; c. You will not re-deposit or re-present the item; d. All information you provide to Ventura County Credit Union in connection with the item is accurate and true; e. You are in compliance with this Agreement and with all applicable laws, rules and regulations; f. You are not aware of any factor which may impair the collectability of the item; and g. You will indemnify and hold harmless Ventura County Credit Union from any loss resulting from any breach of this warranty provision. You agree that you will not use Remote Deposit to electronically present to Ventura County Credit Union for deposit any of the following items: a. Any check or item payable to any person or entity other than you; b. Items that are drawn on your own account here at Ventura County Credit Union (either personal or business affiliated account); c. Any check or item containing an alteration on the front of the check or item, or which you know or suspect, or should know or suspect is fraudulent or otherwise not authorized by the owner of the account on which the check or item is drawn; d. Any check or item payable jointly, unless deposited into an account in the name of all payees; e. Any check previously converted to a substitute check, as defined in Regulation CC; f. Any check drawn on a financial institution located outside the United States; g. Any check that is a remotely created check, as defined in Regulation CC; h.   • Mobile Deposit Security You will complete each deposit promptly. If you are unable to complete your deposit promptly, you will ensure that your mobile device remains securely in your possession until the deposit has been completed. It is your responsibility to establish and maintain procedures to safeguard against unauthorized deposits. You will notify us immediately by telephone with written confirmation if you learn of any loss or theft of original checks. You will ensure the safety and integrity of original checks from the time of receipt until the time of destruction. If warranted in our reasonable judgment, we may audit and monitor you, and you agree to cooperate with us to permit such monitoring, to confirm that you have satisfied your obligations under this Agreement.

  • Mobile Deposit The Mobile Deposit feature enables you to use a software application together with your Wireless Access Device to create electronic images of the front and back of certain Original Checks (defined below) and transmit those images and other information, including, without limitation, information captured from the magnetic ink character recognition (“MICR”) line, to us for review and processing in accordance with this Agreement.

  • The Deposit The Landlord acknowledges receipt of the Deposit from the Tenant. 7.1 At the end of the Tenancy Period, the Landlord shall be entitled to withhold from the Deposit such proportion of the Deposit as may be reasonably necessary to: (a) make good any damage to the Room, Apartment, Common Parts, Building or the Contents (except for fair wear and tear) caused by the Tenant's failure to take reasonable care of the same; (b) replace any of the Contents which may be missing from the Property; (c) pay any Rent or other sums payable by the Tenant hereunder which remains unpaid; (d) compensate the Landlord for, or for rectifying or remedying any major breach by the Tenant of the Tenant's obligations under the Tenancy Agreement, pay for the Room, Apartment and the Contents to be cleaned if the Tenant is in breach of its obligations under clause 2 (e) pay any unpaid accounts for utilities or water charges or environmental services or other similar services or Council Tax incurred at the Room and Apartment for which the Tenant is liable or which are payable because the Tenant does not qualify for Council Tax exemption(g) removing and disposing of any belongings left by the Tenant at the end of the Tenancy term for the avoidance of doubt use of the Deposit is without prejudice to any other rights or remedies of the Landlord whether express or implied 8.1 The Deposit is protected by mydeposits (the trading name of Tenancy Deposit Solutions Limited) of 0xx Xxxxx, Xxxxxxxxx Xxxxx, Xxxxxxx Xxxx, Xxx Xxxxxx, Xxxxxxxxxxxxx, ENS 1NZ. The Deposit is held by the Managing Agents. 8.2 The Landlord has provided the information required under section 213(5) of the Housing Act 2004 as set out in the Housing (Tenancy Deposits) (Prescribed Information) Order 2007 (SI 2007/797). 8.3 The Landlord agrees that the Deposit shall be held in accordance with the rules of the Tenancy Deposit Scheme. 8.4 The Landlord and Tenant agree that any interest accrued from the Deposit shall be paid to the Landlord. 8.5 The Landlord shall inform the Tenant within ten working days of the Tenancy ending if the Landlord intends to withhold all or part of the Deposit as detailed in clause 7.

  • Sub-processing 11.1 The data importer shall not subcontract any of its processing operations performed on behalf of the data exporter under the Clauses without the prior written consent of the data exporter. Where the data importer subcontracts its obligations under the Clauses, with the consent of the data exporter, it shall do so only by way of a written agreement with the sub-processor which imposes the same obligations on the sub- processor as are imposed on the data importer under the Clauses. Where the sub-processor fails to fulfil its data protection obligations under such written agreement the data importer shall remain fully liable to the data exporter for the performance of the sub-processor’s obligations under such agreement. 11.2 The prior written contract between the data importer and the sub-processor shall also provide for a third-party beneficiary clause as laid down in Clause 3 for cases where the data subject is not able to bring the claim for compensation referred to in paragraph 1 of Clause 6 against the data exporter or the data importer because they have factually disappeared or have ceased to exist in law or have become insolvent and no successor entity has assumed the entire legal obligations of the data exporter or data importer by contract or by operation of law. Such third-party liability of the sub-processor shall be limited to its own processing operations under the Clauses. 11.3 The provisions relating to data protection aspects for sub-processing of the contract referred to in paragraph 1 shall be governed by the law of the Member State in which the data exporter is established, namely ........................................ 11.4 The data exporter shall keep a list of sub-processing agreements concluded under the Clauses and notified by the data importer pursuant to Clause 5(j), which shall be updated at least once a year. The list shall be available to the data exporter’s data protection supervisory authority.

  • Grievance Processing Union stewards or Union officials shall be permitted to have time off without loss of pay for the investigation and processing of grievances and arbitrations. Requests for such time off shall be made in advance and shall not be unreasonably denied. The Union will furnish the Employer with a list of Union stewards and their jurisdictions. The Union shall delineate the jurisdiction of Union stewards so that no xxxxxxx need travel between work locations or sub-divisions thereof while investigating grievances. Grievants shall be permitted to have time off without loss of pay for processing their grievances through the contractual grievance procedure, except that for class action grievances no more than three (3) grievants shall be granted such leave.

  • DEPOSIT OF ITEMS You may make deposits to Your Account using any method available from Us, including deposits in person, by mail or electronic means. We have the right to refuse to accept any check or instrument for deposit at Our sole discretion. If You deposit an item and it is returned unpaid, We will debit Your Account for the amount of the item and charge You a fee. You will be liable to Us for the amount of any item You deposit which is returned unpaid, and in addition, will be responsible for any of Our costs and expenses incurred in the collection of such returned item from You, including reasonable attorneys' fees. Subject to Our Funds Availability Policy, You may not be able to withdraw funds from Your Account until We have received final settlement for any items deposited. If You make a deposit on a Saturday, Sunday, or a holiday, or after Our predetermined cut-off hour on business days, the deposit will be credited to Your Account as of the next business day.

  • Principal Depository Borrower shall maintain its principal depository and operating accounts with Bank.

  • Depository Banks The Borrowers and their Subsidiaries will maintain the Administrative Agent as its principal depository bank, including for the maintenance of operating, administrative, cash management, collection activity, and other deposit accounts for the conduct of its business.

  • County of Orange Child Support Enforcement Subrecipient certifies it is in full compliance with all applicable federal and state reporting requirements regarding its employees and with all lawfully served Wage and Earnings Assignment Orders and Notices of Assignments and will continue to be in compliance throughout the term of the Contract with the County of Orange. Failure to comply shall constitute a material breach of the Contract and failure to cure such breach within 60 calendar days of notice from the County shall constitute grounds for termination of the Contract.
