Common use of Removal from Title of the Land Clause in Contracts

Removal from Title of the Land. (a) Council will do all things necessary to allow the Developer to remove the registration of this Agreement from the title of the Land where the Developer has: (i) provided all Monetary Contributions; (ii) Completed the Works; and (iii) dedicated the Designated Land. (b) The Developer must pay any reasonable costs incurred by Council in undertaking that discharge. (c) Clause 10.3 does not merge on completion and shall survive on termination of this Agreement.

(a) 6.3.1 Council will do all things necessary to allow the Developer to remove the registration of this Agreement from the title of the Land (and each newly created lot) where the Developer has: (ia) provided all the Monetary ContributionsContributions attributed to each newly created lot; (ii) Completed the Works; and (iii) dedicated the Designated Land. (b) completed the Works excluding any works required to rectify the Defect as set out in a Defects Notice issued under clause 10.1, and the works required to reconstruct the Sand Filter. 6.3.2 The Developer must pay any reasonable costs incurred by Council in undertaking that discharge. (c) Clause 10.3 does not merge on completion and shall survive on termination of this Agreement.
