Repair and Replace. If SUSE Cloud Observability is held to infringe and its use is prohibited or if, in SUSE’s reasonable opinion, is likely to become the subject of an infringement claim, Customer will permit SUSE, at SUSE’s option and expense, to (a) procure for Customer the right to continue to use SUSE Cloud Observability, or (b) replace or modify it so that it becomes non-infringing and has the same or additional functionality and comparable or improved performance characteristics, provided that if the measures at (a) and/or (b) are not available on a basis that SUSE finds commercially reasonable, SUSE may terminate this Agreement without further liability and refund to Customer the amount paid for the unused portion of the term of the User Subscriptions as of the effective date of said termination.
Repair and Replace. If Next Business Day Advanced Replacement is purchased, replacement parts will be coordinated through the manufacturer’s Technical Support Center after trouble shooting has occurred and verified the equipment is defective. If Manufacturer’s Extended Warranty only is purchased, then the availability of replacement parts are subject to availability in JTS exchange stock and on-hand stock of the Manufacturer. JTS will install a replacement at the Customer’s expense. In the event a replacement part is not immediately available in stock, JTS will notify the Customer and provide priority turnaround of suitable replacement equipment.

Corvis will supply replacement components for Products that have failed. The customer is responsible for first calling Corvis Customer Repair and getting a Return Material Authorization number. The customer is responsible for sending the faulty component to the Corvis designated location along with the assigned RMA# for that module/component. Customer is responsible for packing material, shipping enclosure and all necessary documentation to facilitate the return of the defective component to Corvis. Requests for Basic Repair and Return on replacement module/components received by Corvis by 3:00 p.m. Eastern Time will generally be processed and sent back to customer within 5 business days of receiving the faulty module/component. Requests made after 3:00 p.m. Eastern Time or on weekends or Corvis holidays will be processed the next business day.
