Common use of REPAYABLE RECOVERIES Clause in Contracts

REPAYABLE RECOVERIES. If any part of the Sharing Payment received or recovered by a Recovering Bank becomes repayable and is repaid by such Recovering Bank, then: 27.4.1 each party which has received a share of such Sharing Payment pursuant to Clause 27.2 (Redistribution of Payments) shall, upon request of the Agent, pay to the Agent for account of such Recovering Bank an amount equal to its share of such Sharing Payment; and 27.4.2 such Recovering Bank’s rights of subrogation in respect of any reimbursement shall be cancelled and the relevant Obligor will be liable to the reimbursing party for the amount so reimbursed.

If any part of the Sharing Payment received or recovered by a Recovering Bank becomes repayable and is repaid by such Recovering Bank, then: 27.4.1 29.4.1 each party which has received a share of such Sharing Payment pursuant to Clause 27.2 29.2 (Redistribution of Payments) shall, upon request of the Agent, pay to the Agent for account of such Recovering Bank an amount equal to its share of such Sharing Payment; and 27.4.2 and -120- 124 29.4.2 such Recovering Bank’s 's rights of subrogation in respect of any reimbursement shall be cancelled and the relevant Obligor will be liable to the reimbursing party for the amount so reimbursed.

If any part of the Sharing Payment received or recovered by a Recovering Bank Lender becomes repayable and is repaid by such Recovering BankLender, then: 27.4.1 32.4.1 each party which has received a share of such Sharing Payment pursuant to Clause 27.2 32.2 (Redistribution of Payments) shall, upon request of the Agent, pay to the Agent for account of such Recovering Bank Lender an amount equal to its share of such Sharing Payment; and 27.4.2 32.4.2 such Recovering BankXxxxxx’s rights of subrogation in respect of any reimbursement shall be cancelled and the relevant Obligor will be liable to the reimbursing party for the amount so reimbursed.

If any part of the Sharing Payment received or recovered by a Recovering Bank becomes repayable and is repaid by such Recovering Bank, then: 27.4.1 28.4.1 each party which has received a share of such Sharing Payment pursuant to Clause 27.2 28.2 (Redistribution of Payments) shall, upon request of the Agent, pay to the Agent for account of such Recovering Bank an amount equal to its share of such Sharing Payment; and 27.4.2 28.4.2 such Recovering Bank’s 's rights of subrogation in respect of any reimbursement shall be cancelled and the relevant Obligor will be liable to the reimbursing party for the amount so reimbursed.

If any part of the Sharing Payment received or recovered by a Recovering Bank becomes repayable and is repaid by such Recovering Bank, then:: 158 27.4.1 33.4.1 each party which has received a share of such Sharing Payment pursuant to Clause 27.2 33.2 (Redistribution of Payments) shall, upon request of the Agent, pay to the Agent for account of such Recovering Bank an amount equal to its share of such Sharing Payment; and 27.4.2 33.4.2 such Recovering Bank’s 's rights of subrogation in respect of any reimbursement shall be cancelled and the relevant Obligor will be liable to the reimbursing party for the amount so reimbursed.

If any part of the Sharing Payment received or recovered by a Recovering Bank becomes repayable and is repaid by such Recovering Bank, then: 27.4.1 (a) each party which has received a share of such Sharing Payment pursuant to Clause 27.2 26.2 (Redistribution of Payments) shall, upon request of the Facility Agent, pay to the Facility Agent for account of such Recovering Bank an amount equal to its share of such Sharing Payment; and 27.4.2 (b) such Recovering Bank’s rights of subrogation in respect of any reimbursement assignment shall be cancelled and the relevant Obligor Borrower will be liable to the reimbursing of the party for the amount so reimbursedreimbursed and the Recovering Bank shall re-assign any claims assigned to it pursuant to Clause 26.3 (Recovering Bank’s Rights).

If any part of the Sharing Payment received or recovered by a Recovering Bank becomes repayable and is repaid by such Recovering Bank, then: 27.4.1 each party which has received a share of such Sharing Payment pursuant to Clause 27.2 (Redistribution of Payments) shall, upon request of the Agent, pay to the Agent for account of such Recovering Bank an amount equal to its share of such Sharing Payment; and 27.4.2 such Recovering Bank’s 's rights of subrogation in respect of any reimbursement shall be cancelled and the relevant Obligor will be liable to the reimbursing party for the amount so reimbursed.

If any part of the Sharing Payment sum (a "relevant sum") received or recovered by a Recovering Bank becomes repayable and is repaid by such Recovering Bank, then: 27.4.1 26.4.1 each party Bank which has received a share of such Sharing Payment pursuant to relevant sum by reason of the implementation of Clause 27.2 26.1 (Redistribution of PaymentsPAYMENTS TO BANKS) shall, upon request of the Agent, pay to the Agent for account of such Recovering Bank an amount equal to its share of such Sharing Paymentrelevant sum; and 27.4.2 26.4.2 such Recovering Bank’s 's rights of subrogation in respect of any reimbursement shall be cancelled and the relevant Obligor will be liable to the reimbursing party for the amount so reimbursed.
