Common use of Repeated or Willful Noncompliance Clause in Contracts

Repeated or Willful Noncompliance. 9.4.1 The Interconnection provided hereunder may be discontinued by either Party upon thirty (30) days written notice to the other for repeated or willful violation of and/or a refusal to comply with this Agreement. The Party discontinuing will notify the appropriate federal and/or state regulatory bodies concurrently with the notice to the other Party of the prospective discontinuance.

Interconnection shall not be discontinued if the other Party cures or disputes the alleged violation within the thirty (30) day time frame of receipt of the written notice. The Party discontinuing will notify the appropriate federal and/or state regulatory bodies concurrently with the notice to the other Party of the prospective discontinuance.
